Confession out in case of girl accused of killing baby in 2001
WEST PALM BEACH, Fla. (AP) -- An appeals court is siding with a Broward County judge in the case of a Tamarac teen who confessed to wrapping underwear around her newborn's neck, putting him in a backpack and throwing him in a canal.
The Fourth District Court of Appeals ruled yesterday that the judge correctly threw out Aimee Weiss' confession in 2004.
Weiss was given a faulty Miranda rights warning form that failed to tell suspects they had the right to an attorney during questioning.
The now retired Broward Circuit Judge Sheldon Shapiro ruled that her statements were inadmissible because she should have been given the correct Miranda warning.
Weiss was 17-years-old when prosecutors say she hid her pregnancy, delivered the baby alone in her home and immediately suffocated the child in April 2001. Now 22, she faces life in prison if convicted.
Weiss says the boy was stillborn.
